ICC APPLICATION – CRIMES IN GAZA
On Friday February 9th, 2024, we have officially requested the International Criminal Court for arrest warrants of the following individuals:
- Mr. Benjamin Netanyahu, as Prime Minister of Israel,
- Mr. Yoav Galant, as Minister of Defence of Israel,
- Mr. Isaac Herzog, as President of Israel.
It is our opinion, as lawyers and in consideration of the existing proofs, that the charges and crimes committed in Gaza, in violation of the most important text of Humanitarian International Law, amount to War Crimes, Crimes Against Humanity and Genocide.
The crimes and their severity demand an urgent investigation and broad charges against the defendants seeing the scale of the suffering inflicted on innocent civilian lives.
This is why we urge the Court, with a 40-page petition that refers to the available evidence, to open an investigation into the crimes committed in Palestine.
The request highlights how the defendants, through their respective roles, have actively breached numerous international provisions, and continue to do so, with impunity in front of a seemingly powerless international community.
Through their leadership, the defendants have inflicted what reads as a collective punishment on the Palestinian population. They have shamelessly been using disproportionate force while intentionally targeting civilians – submitting them to inhumane treatments and arbitrary killings -, medical facilities, – under false justifications – , and cultural inheritance sites.
The actions carried out in Gaza since October 7, 2023 have been documented and recorded by NGOs, media and acknowledged by several governments. Yet, the defendants, at the head of their troops, continue to unleash death and devastation without hindrance. With more than 100,000 victims to date, over 30,000 deaths, and a destruction of over 70% of all civilian infrastructures, it is time for the international community, in the person of his Excellency Khan to step up and held the culprits accountable for their actions.
